These Terms of Use set forth the terms and conditions that apply
to your use of www.flower.co.uk (the "Website"). By using the Website (other than
to read this page for the first time), you agree to comply with all of the Terms
of Use set forth herein. The right to use the Website is personal to you and is not
transferable to any other person or entity.

Ordering Online
This site has been designed to make ordering flowers and gifts in
the Teddington Garden Centre and Buds online store as easy and convenient as possible.
Simply select your choice of bouquet and you will be presented with detailed information
about your chosen arrangement. We aim to ensure this information is accurate and
up-to-date at all times.
Our prices are shown in UK pounds (GBP) and the online transaction
will take place in this currency.
When you want to purchase a product click on the
'add to basket' button. When you have finished adding products to your basket, proceed
to checkout, fill in your details and leave the rest to us.
Please note that all
orders placed on a Sunday will not be processed until Monday morning. Any orders
placed on a UK public holiday will be processed on the next business day.
Ordering by Telephone
If you would prefer to talk to a florist or contact the office
to arrange special delivery options, or perhaps you wish to discuss particular requirements,

Modifying an Order
Unless your order has already been dispatched it can be easily
modified (eg change of delivery address or delivery date). Please call us immediately
on 0208 547 0080.
Overseas Orders
For deliveries of flowers or plants to countries other than UK and
Ireland please contact us by telephone on 0800 989899. As an Interflora member, we
are able to deliver to over 150 countries throughout the world.
Please be aware that
we are unable to accept online orders for delivery outside of the UK and Ireland.
Delivery Charges
All our prices are fully inclusive of VAT (sales tax). There will
be no additions to the advertised price of our products for VAT or other taxes. The
price you see is the price you pay.
Please note we are required by law to collect
VAT regardless of where in the world you are when placing your order.
There is no
tax on International deliveries.
A delivery charge is payable on all delivered arrangements.
The delivery charge is clearly indicated on the checkout form.
Please, however, note
the following:
Multiple gifts going to the same delivery address will be treated as
a single order when delivery charges are calculated.
Multiple gifts going to different
delivery addresses will be treated as individual orders when delivery charges are
calculated.
Multiple gifts going to the same delivery address but on different days
will be treated as individual orders when delivery charges are calculated.
All ancillary
gift items are delivered with the fresh flower arrangements.
Delivery Policy
In the normal course of business, we are able to take orders for same
day delivery if the order is placed before 2pm GMT Monday To Friday (excluding Bank
Holidays). We cannot guarantee the same day delivery of orders that are placed after
2pm GMT Monday to Friday.
We can deliver on Sundays and on public holidays by prior
arrangement. Orders placed online on a Sunday will be processed on Monday.
For peak
floral deliveries such as Valentines Day, Mother's Day and Christmas week, we recommend
that all orders are placed two days in advance to ensure timely delivery; otherwise
we can not guarantee delivery. Further information is posted on our website at appropriate
times of the year.
Please note that at peak periods all timed and priority delivery
services are suspended. This is due to the increased volume of orders at these times.
Please
enter the full address including the postcode of the recipient. We will not be held
responsible for items that are not delivered due to incorrect details being supplied.
Flowers
sent to hospitals, schools, military & business addresses will be delivered to a
main reception or mailing room prior to internal distribution.
We recommend that
orders to such locations be requested for delivery on a weekday and not a Saturday.
Teddington Garden Centre and Buds Florist and its agents are not responsible for
issues with such deliveries where a signature has been obtained. Once a signature
has been obtained, the delivery has been completed.
Evening and timed deliveries are
available in some areas. Once again, please contact us to discuss your requirements.
Order Confirmation
The only information sent with the flowers and/or gift is the personal
message card. We do not pass on any other details at all and do not send out an invoice
or receipt. You will get an email confirmation of your order which acts as your receipt.
You will get email confirmations of payment from the transaction handler that you
have used.
Failed Delivery
Should the recipient be away at the time of delivery, a card will
be left stating attempted delivery and will include details of how to collect them
or arrange re-delivery.
Substitution Policy
Our primary objective when we receive an order from you is to
ensure that we deliver on the day requested and that we deliver a fresh quality product
of the type and value ordered.
To meet this objective it is sometimes necessary for
the florist to use blooms, or other elements of the product, which are different
to those shown in the photographs in our online shop. Some variation in colour or
style may result, but never in quality or value.
Be assured - if you order a rose
bouquet we will deliver a rose bouquet or if you order a luxury arrangement then
we will deliver a luxury arrangement.
So, in the unlikely event of supply difficulties,
Teddington Garden Centre and Buds Florist reserves the right to substitute any product
with any other type of equal or greater quality and value.
If you are in any way
dissatisfied with a floral product ordered from us we will collect the product and
make a full refund provided your complaint is received within 24 hours of delivery.
Returns Policy and Cancellation Rights
If you are in any way disappointed with our
flowers or service, please telephone us on 0500 989899.
Cancelling an Order
If you wish to cancel an order please contact us on 0500 989899
as quickly as possible.
Please note that we can accept order cancellations at any
time prior to dispatch.
We can easily cancel your order if it has not already been
delivered, or if it is not on its way to being delivered.
However, we are unable
to cancel your order if it has already been sent out for delivery. The perishable
nature of the goods we sell (flowers) means that you have no cancellation rights
under the Distance Selling Regulations (2000) (see below).
For non-perishable items:
In accordance with Distance Selling Regulations (2000) and the Consumer Protection
(Distance Selling)(Amendment) Regulations 2005, you may cancel your order at any
time without reason, within 7 working days of delivery.
Should you wish to cancel
your order and receive a refund, you must confirm this in writing within 7 working
days of receipt and return the packaged item to us at the address given above. The
item(s) must be returned to us unused and in as new condition. You will be liable
for all postage costs incurred as a result of returning an item to us. We cannot
issue a refund until we have received the goods. We recommend you obtain proof of
posting when you return any goods to us. Please note this policy excludes all our
flower products as these are perishable goods and exempt from this legislation. This
does not affect your statutory rights as a consumer.
For perishable items:
If your
order has been placed in advance you may cancel your order in writing any time prior
to despatch without cost. Any monies paid will be refunded to you in full. This offer
does not apply to custom arrangements where a special order has been made on your
behalf.
Please note you have no right to refund on Perishable Goods that we supply
which include but is not limited to flowers and chocolates.
Champagne and Wine
Under the Licensing Act of 1964 (UK) and 1976 (Scotland) it is
an offence for any person under 18 years to buy, or attempt to buy, alcoholic liquor.
It is an offence under Sections 32 and 33 of the Intoxicating Liquor Act 1988 (Republic
of Ireland) for any person under 18 years to buy, to attempt to buy, intoxicating
liquor.
It is an offence under the Licensing (Northern Ireland) Order 1990 for any
person under 18 years to buy, to attempt to buy, intoxicating liquor. Champagne is
distributed in Northern Ireland in association with a licensed third party. Making
a Complaint
If you have cause for complaint this must be received within 24 hours
of taking delivery. We will happily:
1. Provide you with a replacement, or
2. Collect
the product and give you a full refund.
Our customer service phone line is personally
operated between 9am and 5.00pm Monday to Saturday. An answer machine service is
in operation at all other times. You may also complete the feedback form.
We aim to
respond to customer service matters within one working day and resolve all complaints
within three working days.

The personal message with the gifts is positioned so it cannot be read during transit.
We use the personal information that you provide to process your orders online and
to keep you advised about our products and services.
However, we will not use your
details to contact you regarding future promotions and offers unless you opt-in to
such marketing during the order process. Any future email marketing we may send will
include an unsubscribe option. You can withdraw your consent at any time.
From time
to time, we may share data with selected third parties. Again, you will be asked
to opt-in and your consent must be given before we will add you to such mailing lists.
If
you wish to add or remove yourself from our mailing lists at a later date or if you
have any questions or comments about privacy you can do so by contacting us by telephone

Cookies are used on this shopping site to keep track of the contents
of your shopping cart.
Our cookies are only temporary. No information will be permanently
stored in the cookie file on the client. The cookies are used to enhance a user's
experience in a dynamic and database-driven web site.
Credit Card Security
Teddington Garden Centre and Buds Florist accepts payment from all major credit and debit cards, including Visa, Mastercard, American Express, as well as debit cards and PayPal account balances.
This site uses the Paypal system for online credit card transactions. Paypal is the payment gateway of choice for over 57 million account users in the UK. All payment information is transmitted in secure mode and is encrypted using online security encryption. Firewalls within the Paypal system are structured to prevent any unauthorised access to your information.
Credit card details are captured within the Paypal secure system, and no card details
are stored on your computer or computers belonging to Teddington Garden Centre and
Buds Florist. When your order has been placed, you will receive an email from Paypal
to confirm the payment has been successful.

Terms and conditions for orders
This website trades as part of the Interflora Florists Online scheme operated by
TEDDINGTON GARDEN CENTRE and Interflora British Unit. The terms and conditions below
outline the service we make available to you.
These terms and conditions (the "Terms
and Conditions") are the terms and conditions upon which Interflora British Unit
("we/us") make this website (the "Interflora Florists Online Site") available to
you and any of our services which are accessible on or via the Interflora Site (the
"Interflora Service").
These Terms and Conditions govern your use of the Interflora
Florists Online Site and the Interflora Florists Online Service.
1. Products
1.1 All products as depicted on this website (as may be varied from time to time)
are available almost everywhere in the UK, Channel Islands, Republic of Ireland and
Isle of Man - or as otherwise directed. Certain product ranges are available in selected
delivery areas only.
1.2 Certain flower and plant products may be delivered in bud
to ensure longer life.
1.3 Some flower and plant products may be harmful or poisonous,
if you require further information before submitting an order please contact the
Interflora Customer Services Team using the contact details set out in Section 7
below.
1.4 All products are subject to availability. In the event of any supply difficulties,
we reserve the right to substitute with a product of equivalent value and quality
without notice.
1.5 In the event that we are unable to supply all or part of your
order (the product or any substitute product to you at all), we shall notify you
as soon as possible and reimburse your payment in full no later than 30 days after
the intended delivery date.
1.6 We are unable to offer Champagne or other Finishing
Touch items with products ordered from selected ranges, this will be made clear when
placing your order.
1.7 Products are delivered next day unless other delivery date
or service is selected.
1.8 Selected products are not available for same day delivery
or other special delivery services. Further information regarding product availability
and delivery options will be presented when placing your order.
1.9 Restrictions apply
to selected Gift Experiences, for example, a driving licence may be required. Please
check before booking your experience at www.redletterdays.co.uk.
1.10 We guarantee
the freshness of your flowers for 7 days. Roses, summer and spring flowers will be
guaranteed for a period of 5 days.
2 Alcoholic gifts
2.1 Under the Licensing Act of 1964 (UK) and 1976 (Scotland) it is an offence for
any person under 18 years to buy, or attempt to buy, alcoholic liquor. It is an offence
under Sections 32 and 33 of the Intoxicating Liquor Act 1988 (Ireland) for any person
under 18 to buy, or attempt to buy, intoxicating liquor. It is an offence under Licensing
(Northern Ireland) Order 1990 for any person under 18 to buy, or attempt to buy,
intoxicating liquor.
2.2 Alcoholic gifts are distributed to selected areas in association
with a licensed third party, for further information regarding our suppliers contact
our Customer Services Team.
3. Prices
3.1 Prices listed within the Interflora Service are valid for a maximum of 14 days
of submitting your purchase form.
3.2 Prices include VAT for deliveries within the
UK, Republic of Ireland and Channel Islands.
3.3 Except where stated product prices
exclude Interflora Delivery.
3.4 Product prices for items requiring delivery outside
of the UK, Republic of Ireland and Channel Islands exclude transmission or delivery
charges.
4. Orders / Payment
4.1 You will be given clear instructions to navigate the order process and will be
required to provide us with your complete personal details, including accurate postcode,
together with those of the intended recipient and all necessary payment details.
4.2
We accept payment by all major credit and/or debit cards other than Diners, department
store cards and any other credit and/or debit cards as we may specify from time to
time.
4.3 By clicking on the 'check out' button at the end of the order process,
you are consenting to be bound by our terms and conditions contained in these Terms
and Conditions and appearing anywhere on the Interflora Florists Online site.
4.4
Submitting your order is subject to our acceptance of this offer. We will send an
email confirmation of your order details to advise that we are processing your order
via the email address you provide. We will not consider ourselves bound by a contract
with you until we have issued this email confirmation.
4.5 We cannot accept orders
from customers under the age of eighteen (18) years.
5. Delivery
5.1 Except where stated, Standard Delivery is next day, and a charge of £4.99 will
be applicable within the UK, Republic of Ireland, Isle of Man and Channel Islands.
If you request delivery to remote areas which are not normally delivered to by Interflora
you will be advised of any additional charges as soon as possible upon receipt of
your order.
5.2 Selected products are not available for delivery to certain areas
- where possible we will advise you of these restrictions before you place your order.
5.3 Some products will be delivered via courier or postal services to UK mainland
addresses. When ordering, we will advise you of the first available delivery date
for your chosen item. Whilst every effort will be made to deliver on your chosen
date, the exact delivery date cannot be guaranteed. Please be advised that delivery
may take place within 48 hours of your preferred delivery date. Products delivered
via courier or postal services are not currently available for delivery to the Channel
Islands, Scilly Isles, BFPO addresses or hospitals.
5.4 Delivery Services - Should
you require your delivery to be made within a specific time period we are able to
offer the following delivery services. Please note some services are subject to availability.
We will advise you of services available at the time of placing your order:
5.4.1
Same day delivery at a charge of £6.99 (except where noted).
5.4.2 'Before 1pm'/'after
1pm' service at a charge of £3 in addition to Interflora Delivery of £4.99. This
delivery option is not currently available when ordering online so please call 0870
366 6555 to place your order. The service is offered to orders for delivery within
the UK, Republic of Ireland, Isle of Man and Channel Islands. Should you require
this delivery service, your order must be placed by 2pm, 24 hours in advance of the
required delivery date (2pm Saturday in the case of Monday deliveries). This delivery
service is offered subject to availability and may be withdrawn without notice during
busy periods.
5.4.3 '3 hour delivery' service is available at a charge of £6.00 in
addition to Interflora Delivery of £4.99. This delivery option is not currently available
when ordering online so please call 0870 366 6555 to place your order. The service
is offered for orders to selected delivery locations within the UK, Republic of Ireland,
Isle of Man and Channel Islands. Please request this service at the time of placing
your order. This delivery service is offered subject to availability and may be withdrawn
without notice during busy periods. We regret this delivery service is not available
for orders requesting Champagne as part of the order.
5.5 Orders for products delivered
via courier or postal services received before 2pm Monday to Thursday can normally
be despatched the same day for next day delivery almost anywhere in mainland UK subject
to availability. Please be advised that delivery may take place within 48 hours of
your preferred delivery date. Orders received before 12 noon on Friday will normally
be despatched the same day for Monday delivery almost anywhere within mainland UK.
Deliveries to Scottish Highlands, UK islands, Isle of Man, Guernsey and Jersey may
take three working days. For certain areas of Scotland, Republic of Ireland and Wales
- allow an additional 48 hours after the requested delivery date.
5.6 Your intended
delivery date will be confirmed in your email order confirmation. We will process
orders received on Sundays or Public Holidays the next working day.
5.7 Delivery is
not available on Sundays or public holidays, orders will be delivered on the next
working day.
5.8 To avoid problems or delays with delivery, please ensure that you
have included the full address details, including accurate postcode of the intended
recipient and telephone number, together with your daytime contact telephone number
or e-mail address so that we can notify you in the event that any delivery problems
are encountered.
5.9 Certain products will be delivered during a delivery period,
providing delivery within a time frame around your preferred delivery date - you
will be advised of this at the time of placing your order.
5.10 Whilst we agree to
use all reasonable endeavours to ensure that delivery will be on the requested delivery
date or during the delivery period, you acknowledge that actual delivery will be
via a local florist or for certain orders via third party courier or postal service.
In very occasional circumstances delivery on the requested terms will not be possible,
in such circumstances you will be given prior notice wherever possible and we shall
either make alternative arrangements or reimburse your payment in full in accordance
with clause 1.5 above. Goods delivered via third party services are generally despatched
24 hours before the requested delivery date for most UK mainland addresses. For deliveries
via third party to Northern Ireland, Wales and some areas of Scotland, please allow
up to an additional 48 hours after the requested delivery date for delivery to be
made.
5.11 In the case of delivery to certain locations, where a third party is involved,
such as offices, hospitals, Funeral Directors, airports, hotels, ships and other
business locations, the signature of any person authorised to accept delivery on
behalf of the organisation shall be accepted as proof of delivery to your chosen
recipient. Please be advised that some products are unsuitable for delivery to Funeral
Directors, Hospitals, airports or ships – please contact Inteflora Customer Services
for further information using the contact details set out in Section 7 below.
5.12
Please note that the carrier is only responsible for delivering to the address you
quote (or to a neighbour if no one is at home) we regret that where the goods have
been correctly delivered we cannot accept responsibility if the intended recipient
has moved, or lives elsewhere, and the actual receiver refuses or fails to return
item(s).
5.13 Where the carrier is unable to find someone to accept delivery they
will either deliver to a neighbour or leave a card at the address for the recipient
to make contact.
5.14 In respect of orders outside the UK, Channel Islands and Republic
of Ireland, delivery shall be made as soon as is reasonably practicable, but you
acknowledge that delivery on the intended delivery date, particularly in respect
of orders received for same day delivery or for Sundays and Public Holidays, cannot
be guaranteed.
5.15 It is possible to select a preferred delivery time within the
order process for items ordered from the 'Sympathy' & 'Funeral' product ranges. This
option should be used only for orders requesting delivery to funerals or funeral
parlours. Whilst every effort will be made to ensure your order is delivered prior
to the time selected, no guarantee for delivery by the time specified can be given.
To assist us in meeting your preference, please ensure your order is placed at least
two working days prior to the preferred delivery time.
5.16 In the instance of there
being difficulties in delivering your order to the intended recipient we (including
the florist or third party delivering your order) reserve the right to contact the
recipient using the contact details you provide at the time of placing your order.
5.17 When placing your order you are able to specify further delivery information
using the 'Delivery Information' field provided. This is intended to provide further
guidance to the party delivering your order which isn't included within your address
information – for example to specify floor number, or hospital ward. We reserve the
right to not action any delivery requests specified in this field which we deem unacceptable
and will use other elements of address information provided elsewhere on your order
to fulfill your order.
5.18 Before placing your order, please review delivery cut-off
times & prices.
6. Cancellation
6.1 Orders may be amended or cancelled up to 3 working days before the intended delivery
date.
6.2 To amend or cancel your order, please contact the Interflora Customer Services
Team from 8am until 6pm Monday to Friday and 8am until 5pm on Saturday using the
contact details set out in Section 7 below.
6.3 We regret that you may not cancel
an order for perishable food products once your order has been dispatched.
6.4 You
are entitled to cancel any payment at any time where fraudulent use has been made
of your credit or debit card by another person not acting on behalf of you or as
your agent and to be re-credited by us to the extent that such sums are not reimbursed
by the card issuer in such circumstances.

7.1 In the event that you are not satisfied with the Interflora Florists Online Service

7.2 Our Customer Services Team is available from 8am until 6pm Monday to Friday
and 8am until 5pm on Saturday.
7.3 Because of the perishable nature of most products
and in order to assist us in resolving any complaints quickly and to our mutual satisfaction,
we advise you to make any complaint within 1 working day of the date of delivery
or intended delivery of your purchase.
8. Disclaimer
8.1 Whilst we agree to use all reasonable endeavours to ensure that the Interflora
Florists Online Site and/or the Interflora Florists Online Service is fully operational
and error-free we cannot guarantee this and, therefore, accept no responsibility
for any defects and/or interruption of the Interflora Florists Online Site and/or
the Interflora Florists Online Service and shall be released from our obligations
under these Terms and Conditions in the event of any cause beyond our reasonable
control which renders the provision of the Interflora Florists Online Site and/or
the Interflora Florists Online Service impossible or impractical.
8.2 (a) We accept
liability for death or personal injury arising from our negligence.
8.2 (b) Subject
to clause 8.2(a), our liability in contract, tort (including negligence and breach
of statutory duty) or otherwise arising by reason of or in connection with your order
with us shall be limited to a multiple of [5] times the price you have paid for the
products.
8.2 (c) Subject to clauses 8.2(a) and 8.2(b) above we exclude all liability
for any claims, losses, demands and damages, including without limitation, any costs,
loss of profits, loss of contracts or business opportunity, loss of data and any
other consequential, incidental, special or punitive damages, even if we have been
advised of the possibility of such damages, arising directly or indirectly out of
or in any way connected with your use or inability to access the Interflora Florists
Online Site and/or the Interflora Florists Online Service, whether arising in contract,
tort (including negligence), under statute or otherwise PROVIDED THAT nothing contained
in these Terms and Conditions affects or will affect your or the recipient's statutory
rights in relation to the quality, fitness or description of the products supplied.
8.2
(d) Subject to clauses 1.5 and 5.3 above, we shall not be liable for any delay or
inability to perform our obligations to you if such delay is due to any cause whatsoever
beyond our reasonable control.
9. General
9.1 We reserve the right to supplement and amend the Terms and Conditions on which
you are permitted access to the Interflora Site and/or the Interflora Service from
time to time. We will post any changes on the Interflora Site and it is your responsibility
as a customer to review the Terms and Conditions on each occasion you access the
Interflora Service or Interflora Site. Changes will be effective five (5) hours after
the posting of any such change and all subsequent dealings between you and us shall
be on the new terms and conditions.
9.2 Additionally, we reserve the right to suspend,
restrict or terminate access to the Interflora Site and/or the Interflora Services
for any reason at any time.
9.3 These Terms and Conditions shall be deemed to include

My Account service - terms and conditions
1. My Account service ('the Service') is provided as a complimentary feature by Interflora
Florists Online and Interflora British Unit ('Interflora') for your personal use
subject to these Terms and Conditions. In order to provide the Service, we will hold
certain personal information. Except to the extent that we are required or permitted
by law, any personal information which we collect will be used solely for the purposes
of providing the Service.
2. To register with the Service you must be over eighteen
years of age.
3. When you register with the Service you will be required to create
a password. You must keep this password confidential and must not disclose it or
share it with anyone. You will be responsible for all activities and orders that
occur or are submitted under your password. If you know or suspect that someone else
knows your password you should notify us immediately. Should you forget your password,
